At Herolens we take our clients (“Advertisers”) and our client´s users or customers or future customers (“Users”) privacy very seriously. The purpose of this Privacy Policy is to explain how through Herolens’ “Real Time Programmatic Creative advertising solution” we may collect, retain, process, share and transfer Advertisers and/or Users’ Personal Information.

For the purposes of these Privacy Policies Advertisers  shall be natural persons or companies (including its employees) that request Herolens’ services to advertise their own or third parties’ goods and services through the internet. Thus, Advertisers shall be considered as advertisers.

Users shall be any natural person who in general uses internet for all lawful permitted activities and especially to find goods and services through different websites, for example, a user of an e-commerce site looking to purchase a particular product

Herolens reserves the right, at Herolens’ discretion, to change this Privacy Policy from time to time to reflect changes to Herolens’ business, the sites or services, or applicable laws. For that purpose, we will provide Advertisers and Users with thirty (30) days prior notice for any change on the “Privacy Policy” page of Herolens’ website. We also may notify Advertisers of the change using a contact information, email or other means of contact if provided by Advertisers and Users. We are not responsible if Advertisers choose not to provide this information to the Users.  The revised Privacy Policy will be effective as of the publication date. Advertisers and Users may contact us if  they have questions about Herolens’ privacy practices that are not addressed in this Privacy Policy.

About Herolens Service

Herolens is a Programatic Creative Collect Platform Platform (“Platform”) that automatically generates dynamic HTML5, video or image content ads ads on the fly given any kind of data accross all screens. By request of Advertisers, or by any technological mean which may be provided by Herolens to Advertisers in the future, Herolens’ technology enhances Users online shopping experience while improving communication between a brand and its audience through innovative, engaging, professionally designed ads (“the Service”).

These ads result in higher engagement and ROI to Herolens’ Advertisers. Herolens’ objective is to provide, best optimized and dynamic rich media and video ads to Users across the web,  applications, and other platforms, while augmenting the creative production capability of Advertisers.

Herolens firmly believes in creative dynamization as a mean of generating more engaging experiences for Users and augmenting the creative output of Advertisers.

Herolens Service is actually not intended for Advertisers and/or Users residing in Europe. Nevertheless, Herolens’ Services shall be available to Advertisers and/or Users residing in Europe in the future. Thus, Herolens respects and is in a constantly effort to be in compliance with the European General Data Protection Regulation 2016/679 (“GDPR”) to protect, warrant and preserve the rights to those Advertisers and/or Users to may eventually apply or to be served.

What Information Does Herolens Programmatic Creative Collect and how is collected?

User Information:

Herolens processes personal information of Users to offer its Service (“Personal Information”). In this regard, Personal Information may be processed for commercial and Advertiser analysis, reporting and statistical purposes, marketing purposes (for example,  customized marketing or direct marketing, if applicable unless rejected by Users), administration notices, database management and maintenance, product suggestions and offers, interaction with third parties social networks, access to third party services' accounts and platforms and newsletters.

As an example, when a Advertiser hires Herolens’ Service to advertise a product, Herolens might be aware of when and how many times  a Final User have recently visited several products or pages through Advertisers´ websites. This information is used to show to the Users, videos and ads through diferent ways related to those products, as a mean of generating more engaging experiences for the Users.

In general, User’s Personal Information shall include: IP (internet protocol) adresses, Timezones and Cookies. Particularly, Herolens may collect the following information and its purposes:


Herolens uses this information to help Advertisers serve ads and so they are able to identify  the Users that are more relevant to them and to operate, improve and enhance Herolens’ Service

In order to perform the Service, the Platform may use cookies, tracking pixels and related technologies. Cookies are small data files that are served by Herolens Platform and stored on the User’s device. They enable us to identify User’s devices when Users use and navigate through different websites and applications in order to serve targeted advertising of Advertiser’s products and services to the Users.

Herolens may choose to collect anonymous information through the use of browser cookies and/or via User interaction or engagement with Herolens’ ads (viewing ad impressions or clicking the ad). Browser cookies record are, for example, pages the User browsed on Advertisers’ websites. Herolens Platform is integrated with Advertisers’ websites, therefore once the User visits Advertisers´ website, its browser sends an anonymous cookie to Herolens Platform, and based on the information stored there, the User should receive better-targeted and relevant ads than standard User would receive without using Herolens Platform.

Advertiser Data:

Herolens will collect from Advertisers the following information:

Herolens collects Personal Information from its Advertisers when the Advertiser hires Herolens Services for creating a new Account (“Advertisers Account”). As a result of hiring Herolens’ services, Herolens asume that all Personal Information of the Client and collected and processed by Herolens is provided with the expressed consent of the Advertiser. In no event Herolens will collect Personal Information from the Advertiser that has no consent and its not voluntarily given by the Advertiser.

Advertisers may request Herolens the removal of Herolens’ cookies and opt-out by sending an email to privacy@herolens.com with the subject OPT-OUT.

Advertisers may request to opt-in again in order to receive a better targeted and personalized ad experience by sending an email to privacy@herolens.com with the subject OPT-IN.

What Privacy Choices Are Available To Advertisers and Users ?

Users have (and Advertisers may have) choices to the privacy practices and communications described in this Privacy Policy.  Many of Advertisers and Users choices may be also explained in Advertiser´s websites, and be performed at the time Advertisers and Users use a service or a site.  Advertisers and Users may be provided with instructions and prompts within the experiences as they navigate the Services.  

Choices Relating to the Personal Information Herolens Advertisers and Users may decline to provide Personal Information when it is requested by Herolens Advertisers or Herolens, but certain Services or all of the Services may be unavailable to Advertisers and Users. 

Location and other device-level information.  The device Users use to access Advertiser’s sites or Service may collect information about them, including Geolocation Information (only their Country Code) and their IP that Herolens may then collect and use. For information about Advertisers’ ability to restrict the collection and use of such information, please use the settings available in the device.

Choices Relating to Cookies. Users may have options available to manage cookies preferences. For example, Users browser or internet device may allow Users to delete, disable, or block certain cookies and other tracking technologies.  Users may choose to enable these options, but doing so may prevent Users from using many of the core features and functions of the Service and to relegate a better experience.

Users may have an option regarding the use of cookies and other tracking technologies when they use the Service or visit parts of an Advertiser’s site.  For example, Users may be asked if they want the Service or the site to “remember” certain things about them, and Herolens will use cookies and other tracking technologies to the extent that Users permit them.

Choices Relating to the Advertiser´s Registration and Account Information. Advertisers have an Account, and they generally may review and edit Personal Information by logging in and updating their information directly or by contacting us.

Display Of Herolens Programmatic Creative Ads

Herolens’ Programmatic Creative ads run on many Internet websites and mobile applications as part of their promotion, advertising and video programming. The ads could appear in relevant product pages, as standalone ads, social media posts or ads, banners and before or during the playback of a video that Users chose to watch. Many of these publishers may access Herolens through third-party advertising networks or ad exchanges.

Those advertising networks, like Google, may also place cookies on the User´s browser upon visiting a Herolens Advertiser’s website to facilitate ad serving as described above. Users may opt-out those cookies by visiting those advertising network opt-out pages. For example,  the User may opt out of Google’s use of cookies by visiting the Google advertising opt-out page. here In addition, the  User can opt-out of any other third party vendor’s use of cookies by visiting the Network Advertising Initiative opt out page.

Why Do We Retain Personal Information?

Herolens has no interest in retaining Personal Information about Users and Advertisers for any other purpose than the effectiveness of its Service.  Herolens may retain Personal Information to fulfill Herolens’ legal obligations and for Herolens’ business purposes. Herolens may retain Personal Information of Users for targeting purposes for 180 (a hundred and eighty) days as a maximum length. Herolens may retain Personal Information for longer periods than required by law if it is in Herolens’ legitimate business interests and not prohibited by law.  In case Herolens need to close a Advertiser Account, Herolens may take steps to mask Personal Information and other information, but we reserve Herolens’ ability to retain and access the data for so long as required to comply with applicable laws.  We will continue to use and disclose such Personal Information in accordance with this Privacy Policy.

How Do We Process Personal Information?

Herolens may ask for Advertisers and/or Users consent for the processing of certain type of Personal Information. When collecting such consents, Herolens inform the Advertisers and/or Users of the respective purposes of processing and such processing is conducted only when appropriate consent is received.

Do We Share/Transfer Personal Information?

Only for the purposes stated in this Privacy Policy and to perform the Service, Personal Information may be disclosed by Herolens, when necessary, to authorities, other companies within the same Herolens affiliates, Herolens’ partners and to other third parties, such as third party service providers used in connection with Herolens Service and services related thereto. In some cases, Personal Information may be transferred outside the European Union and the European Economic Area (“EU/EEA”), including but not limited to, the United States of America, asian and latin american countries as well where Herolens conduct its business. Such transfers outside the EU/EEA are performed subject to appropriate safeguards and safety measures such as standard data protection clauses adopted in respective agreements or otherwise approved by the EU Commission in accordance with the GDPR. The applicable Standard Data Protection Clauses in the respective agreements may be available for review to Users upon apropiate request.

In other cases for different jurisdictions, like but not limited to, Argentina, Personal Information may be transferred outside the country to countries with the same or better levels of protection. In case the Personal Information is transferred to countries with lower levels of protections, Herolens will perform those transfers subject to appropriate safeguards and safety measures such as standard data protection clauses adopted in respective agreements or otherwise approved by the legal applicable authority.

How Do We Protect Advertisers and Users Personal Information?

Herolens maintain technical, physical, and administrative security measures designed to provide reasonable protection for Advertisers and Users Personal Information against loss, misuse, unauthorized access, disclosure, and alteration.  The security measures include firewalls, end-to-end data encryption, and information access authorization controls.  Nevertheless, considering the actual online environment is not fully secured, Herolens shall not guarantee that security measures taken will prevent illegally and maliciously operating third parties from obtaining access to Advertisers and Users Personal Information and the absolute security of that information during its transmission or its storage on Herolens systems. While Herolens is dedicated to securing its systems and Service, Advertisers are responsible for securing and maintaining the privacy of their password(s) and Account, registration information and verifying that the Personal Information Herolens maintain about the Advertisers is accurate and current.

Which are the Users and Advertisers’ Rights?

Users and Advertisers have the right to request from us:

Users and Advertisers may exercise the aforementioned rights by sending a written request to us at privacy@herolens.com. Where the processing is based on consent, User or Advertiser has a right to withdraw such consent at any time. Said withdrawal will not affect the lawfulness of processing based on consent before its withdrawal. In case the User or Advertiser considers that its rights under the data protection laws are infringed, the User or Advertiser may file a complaint with the supervisory authority of the User or Advertiser residence. Links And Third-Party Sites

Herolens may choose to implement and incorporate, as part of the assets in its ad creation, and as a part of the Service specific content from its Advertisers databases. Advertisers that are using  Google services such as: Google Maps / Earth / Places APIs as well as using Herolens Platform, acknowledge and agree to be bound by this Privacy Policy and Google Privacy Policy.

Can Children Use Herolens’ Services?

Service is not aimed nor directed to children under the age of 13.  Herolens do not knowingly collect information, including Personal Information, from children or other individuals who are not legally able to use Advertiser’s Sites and the Service.  If Herolens obtain actual knowledge that may have collected Personal Information from a child under the age of 13, Herolens will promptly delete it, unless Herolens is legally obligated to retain such data.  Please contact Herolens if Advertisers or Users believe that Herolens have mistakenly or unintentionally collected information from a child under the age of 13.

Changes to this Privacy Notice

Changes to this Privacy Notice will be posted on this page. If we make a material change to Herolens’ privacy practices, we will provide notice on the site and by other contact information User or Advertiser has provided.
